You would like to know whether a patent can be filed for your invention.
We investigate to what extent the invention is new and inventive compared to existing technology. After all, an invention must be new and inventive in order to qualify for a valid patent.
We will search the invention in existing publications, especially patent publications. For this, we use commercial patent databases in which we efficiently search the full text – if necessary in machine translation – of millions of patent publications.
If it turns out that the invention already exists, then the invention is not new, unfortunately. Drafting and filing a patent application is not useful in such case.
During the search we usually find a publication that does not exactly describe the invention – so the invention seems new – but does describe technology that is somewhat similar to the invention. We will then assess whether the invention is also inventive.
After the search, we will discuss the possibilities for a patent application with you.
We recommend that you always start with a exploratory novelty search. A positive outcome of the search provides some certainty that an application has some chance of getting to grant.
